Constitutional Scholar on Ted Cruz: A Man Born to a Non-Citizen Father is Not Able to be President


While many on the far left say that Ted Cruz is ineligible simply because he poses a threat to the Democrats’ chance of retaining the White House, the far right is claiming that, according to a strict interpretation of the Constitution at the time of writing, a person born to a non-citizen father outside of the United States is ineligible to be president.

The latter is being argued by Fordham professor Thomas H. Lee, who claims the father’s citizenship was considered over the mother’s when deciding children’s citizenship when the Constitution was written.

Ted Cruz’s presidential eligibility was the topic of discussion in a recent Breitbart interview. In it, Thomas H. Lee considers an originalist view of the Constitution, and spells out what that may mean for a Ted Cruz presidency:

While Lee says the question is ripe for discussion, he ultimately seems to think it should be left up to voters.
