“Flags are flown on holiday events. All we are trying to do is regulate when the flag goes up and when it comes down,” said Lyn Stenbergen the president of the HOA which told Utah residents that flag flying was prohibited.
One board member was enraged when she overheard two members saying that they were tired of looking at the flag. They said ‘Is this flag row?’ and that something needed to be done about it.”
One resident, Erin Worthen, who refused to remove her flag, was fined $75 and warned, “All exterior decorations must be removed within 10 days following the holiday… Please remove your flag from the common area (Utah Community Association Act. 57-8a-219)”
Worthen said, “That is not a holiday decoration. People have died for that, it is not a holiday decoration.”

This is outrageous!
I’ve said this over and over… this needs to be taken to trial. The Supreme court ruled that burning or otherwise defacing a flag is covered under the 1st amendment right to free speech. If burning or defacing a flag is covered, then it only stands to reason that DISPLAYING the flag is covered under the first amendment!! But SOMEBODY has got to take this to court and prove the point once and for all.
