Texas Officials Discover Municipal Judge not a U.S. Citizen


According to Corpus Christi Mayor Pro-Tem Lucy Rubio, city officials placed Judge Burkett on unpaid leave for 90 days. It’s anticipated that she will use that time to complete her citizenship process,

No light was shed on how the city learned that the judge was not a citizen.

Rubio says the city never asked during the qualification process to become a municipal judge whether Burkett was a citizen, and says Burkett never tried to deceive or misrepresent her background.”

According to Rubio, city attorneys have reviewed the matter and determined that Burkett’s rulings remain “valid and lawful.” However, she has cautioned that that may not stop some people from challenging the rulings while the matter gets resolved.

Mayor Pro-Tem Rubio chairs the City’s Municipal Court Committee. She said she is not convinced the city attorney’s opinion is correct and this could be more of a wait-and-see situation. She told KIII reporters, Someone can come back and say, ‘You know what? I’m going to say I don’t agree with her decision, and I’m going to challenge it,’ and they have every right to challenge it.”

Judge Burkett’s husband issued a statement in which he said the job posting only asked if the applicant has the ability to work in the United States. He said she never made any representation that she was a citizen.

Corpus Christi Mayor-Elect Joe McComb told reporters at KIII ABC3 he believed the matter to simply be a paperwork error. “Did the City make a mistake in not asking the right question?” the mayor-elect said, “I don’t think there was any intention by anybody, City or applicant, and so, you make a mistake, you admit it, and you move on and that’s what we’re doing.”

Given the intense focus now on immigration issues, the news of Judge Burkett’s status has become a widespread story and, no doubt, a source of great embarrassment to Corpus Christi officials.
