SCOTUS on Precipice of Stripping Congress of Control Over Immigration


The makeup of the court is currently tilted somewhat to the left. Although there are four justices who are hard core lefties who will rule on virtually every decision in a way that advances the liberal viewpoint and the Democrat party, Justice Kennedy is often a swing vote, leaning somewhat right, but often voting with the left. So too does Chief Justice John Roberts, who seems to have been dazzled by the bright lights of Washington D.C., causing him to uphold obviously incorrect principles including a preposterous ruling for Obamacare the put logic and reason on its head.

And that is why a decision siding with the Obama administration could upend well-established precedent and cause additional tumult and worse regarding immigration policy. Democrats are determined to turn millions of illegal aliens into reliable Democrat voters, and that desire is what is driving their actions to overturn virtually all immigration law.

As the battle over immigration rages on, Congress could soon find itself with little control over the bitterly contested issue, a top expert warns.

“For decades, the Supreme Court has held that authority over immigration is shared between the political branches — the legislative and the executive,”says Jon Feere, legal policy analyst at the Center for Immigration Studies, in an article for The Hill.

“But if the court sides with the Obama administration in United States v. Texas, that balance will forever be upset and Congress will find itself with little recourse.”

If President Obama wins in the case, Congress could for all practical purposes be left out in the cold regarding immigration, according to Feere’s column for The Hill.

According to the Houston Press the case dates back to 2014 when Obama issued an executive order announcing the federal government would defer deportation and offer work permits for about 4 million undocumented immigrants who are the parents of U.S. citizens or legal residents.

“Texas lawyers claim Obama is trying to change immigration law by going around Congress with the executive order.”

And Feere adds: “If the policies are allowed to stand, it would be a huge incentive for the executive branch to conduct more sweeping policy changes through memos rather than through the administrative process.”

It is astonishing that one man simply decided to abrogate our immigration laws and has gotten away with it. It is as if he is a king, and the Congress simply his court to accede to his every wish. Now the Supreme Court will have a chance to remind the president that this is a republic, and the chief executive a servant of the people. Unfortunately, the liberal sitting justices are more than willing to destroy the balance that has existed, and to hand the president power that is not his. Executive orders should never be as sweeping as this or create or abrogate the law.

Liberals have shown one important thing. When the people vote against them, and elected representatives enshrine the wishes of the people into law, the Left will use the court to go around both the people and the legislature. And they will be proud to have done it.
