Repealing the Second Amendment would seemingly be an impossible task. But the left will not so easily give up.
But if the Supreme Court’s decision in Obergefell v. Hodges teaches us anything, it’s that the age of judicial supremacy means that five justices can amend the Constitution far more efficiently than Congress and the state legislatures. And right now there are clearly four Supreme Court justices who are committed to the absurd view that the operative clause of the Second Amendment — “the right of the people to keep and bear Arms, shall not be infringed” — doesn’t actually mean “the right of the people” and therefore doesn’t encompass an individual right to own a weapon, even for self-defense. The only way the 2nd Amendment could be “repealed” is to pass a ballot measure for a new amendment to supercede it which would require at least 35 states to approve it and get the governors of each to sign it. SCOTUS can rule unconstitutionally in individual cases involving it and has done so repeatedly but they are unable to simply repeal it.
They can vote all they want. “SHALL NOT BE INFRINGED” means just that. No exceptions!
They can not do that. It has to go through the legislative branch. If not, then the Supreme court will find themselves one the business end of the 2nd Amendment. Seven bullets is a much easier solution than the war that would otherwise ensue.
False information in late June of this year was the last time the court had to address any issue on the 2 nd amendment. To do away with or even change the second amendement it would have to be repeal by the voters
It takes 2/3 vote of the STATES to repeal or add to any admendment.
The 2nd Amendment can be “repealed”. However the SCOTUS can’t do it. Either 2/3 of both the House AND the Senate must vote “aye” to a specific amendment to the constitution followed by 2/3 of the state legislatures ratifying the change OR 2/3 of the state legislatures must vote for a Constitutional Convention which must then be ratified by 3/4 of the state legislatures.
