Report: Mueller Goes After Donald Jr. with Grand Jury


After the Journal story broke, Reuters followed up with speculation that the grand jury is focusing on the meeting Donald Trump Jr. had with a mysterious Russian lawyer in the midst of the presidential campaign.

What remains a mystery is how a meeting between a private citizen and a private Russian attorney constitutes a crime or a matter for a grand jury to examine.

Under federal rules of criminal procedure, grand jury proceedings are typically sealed and participation is kept secret. Leaking information from a grand jury is a federal crime.

The following grand jury participants must take an oath of secrecy under a threat of criminal contempt of court: a grand juror; an attorney for the government; a person who transcribes recorded testimony; a court reporter; an operator of a recording device; and an interpreter.

The impaneling of a grand jury alone does not indicate any burden of proof has been met or evidence uncovered regarding collusion between the Trump campaign and the Russian government or any other matter under Special Counsel Mueller’s purview.”

Essentially, any federal prosecutor can convene a grand jury at will. So news of the Mueller grand jury at this point is a nothing burger.

Grand juries are the means by which federal criminal indictments are issued, but also serve an investigative purpose that is likely an important aim in this case. Once impaneled, the grand jurors can, typically at the express urging of the prosecutor, issue wide-reaching subpoenas and call before them witnesses.”

In turn, the prosecutor can use this testimony and evidence to assemble a case for probable cause and ask the jury to issue an indictment, all without the defense counsel and other protections with which Americans are familiar from a trial setting.”

In that respect, it’s obvious why some see a grand jury proceeding as a “witch hunt.”

Last night, at a raucous rally in Huntington, West Virginia, President Trump weighed in on the Mueller probe and the media frenzy surrounding it. He slammed Democrats for using the probe as an excuse for their loss last November.

The Russia story is a total fabrication. It’s just an excuse for the greatest loss in the history of American politics,”

Referring to the story, and by implication the related investigation, as a “hoax,” Trump defiantly let the Deep State know he would fight them tooth and nail.

They’re trying to cheat you out of the leadership that you won with a fake story that is demeaning to all of us and most importantly demeaning to our country and demeaning to our Constitution,” Trump told a cheering crowd. “I just hope the final determination is a truly honest one.”

Asked about the Journal story earlier in the day, President Trump’s White House counsel Ty Cobb offered the following statement:

Grand jury matters are typically secret,” he said. “The White House favors anything that accelerates the conclusion of his work fairly.…The White House is committed to fully cooperating with Mr. Mueller.”

Spokesmen for the Mueller investigation offered no comment on the Journal story. Given the fact that the probe team itself may have been the source of the leak, that response is understandable.
