In a recent pre-trial hearing in Xenia, Ohio, a judge agreed with a prosecutor’s motion to prohibit the defendant from mentioning the Constitution or the constitutionality of the law he was charged with violating.
Judge Catherine Barber stated “there will be no mentioning of the Constitution” to the defendant, Virgil Vaduva.
The prosecutor made the claim that mentioning the Constitution “will confuse the jury,” to which Vaduva replied that uttering words on a public sidewalk, his panhandling charge, constitutes free speech.

Unbeleivable, I just went through the criminal process here in the xenia court system because I filed my taxes and found out that my previous employer did not withdraw my city taxes as requested by me to do so, while I was trying to figure this mess out I was charged with 1st degree misdemeanor and fined over $300 and charged $110 court cost while all this year 2015 monies have been withdrawn from my check by my employer to go towards xenia city taxes. I can not beleive the prosecutor “lewis” gets everything dropped and I’ve paid all together close to $1500 and here at christmas. Wonder who was short this year on christmas money? Sure not lewis. I’m astounded by the corruption in this town of xenia, ohio. I’ve lived here all my life and they take in a lot of money from hard working blue coller folks but in return we get nothing. Somthing more than just this article needs to be done. The state attourny general needs to be called in and the courts system and city commision needs to be held accountable and money that was stole from the famlies of this town needs to be returned and charges brought against lewis and his gang. That’s what this disgruntald citizen thinks. Ty have a nice day.
