Obama Plans to Fill the Vacant SCOTUS Seat ‘in Due Time’


The timing of Justice Antonin Scalia’s death is tragic for his family, who are deeply mourning the loss of a husband, father and grandfather. His fellow Justices on SCOTUS have also lost a friend and a great mind. Yet immediately upon the news of his unhappy passing, politics brought a dark shadow over his memory as the reality of an Obama appointment set in.

Obama has demonstrated his contempt for the Constitution, by exceeding his authority as President.  He has said that the Constitution “reflected the fundamental flaw of this country that continues to this day.”  As a Presidential candidate way back in 2002, “Barack Obama described the U.S. Constitution as having “deep flaws” during a September 2001 Chicago public radio program, adding that the country’s Founding Fathers had “an enormous blind spot” when they wrote it,” as reported by NewsMax.

This is why there is so grim an atmosphere looking into what a future Justice appointment will be for President Obama.  But what is the GOP leadership saying?

The RINO’s in Congress have caved to Obama’s demands in the past, therefore it is easy to predict that they will do it again.  When Sotomayor was confirmed to the Supreme Court, 23% of the Republicans in the Senate voted for her.

Senate Majority Leader Mitch McConnell said Saturday that the Senate should wait until a new president is elected to confirm a replacement for Justice Antonin Scalia, whose sudden death Saturday shook Washington and threatened to reshape the 2016 presidential race.

Mr. McConnell, though, said voters must be given a say in the matter, and that means picking a president who will nominate the replacement.

Will this in fact be the case?  Obama’s statement on Saturday night was a direct challenge to the Senate when he delivered the news to America about Scalia’s death from the White House.
“I plan to fulfill my Constitutional responsibilities to nominate a successor in due time. There will be plenty of time for me to do so and for the Senate to fulfill its responsibility to give that person a fair hearing and a timely vote. These are responsibilities that I take seriously, as should everyone.”
The Senate Committee Chairman Charles E. Grassley, who is responsible for controlling the schedule for handling nominees supports a deferment.
He supports deferring until next year, saying Mr. Obama has already turned the courts into a political battleground, so voters should be asked to referee.

“The fact of the matter is that it’s been standard practice over the last nearly 80 years that Supreme Court nominees are not nominated and confirmed during a presidential election year,” Mr. Grassley said. “Given the huge divide in the country, and the fact that this president, above all others, has made no bones about his goal to use the courts to circumvent Congress and push through his own agenda, it only makes sense that we defer to the American people who will elect a new president to select the next Supreme Court justice.”

Of course, the left wants to push a nominee through quickly, without regard for what is best for the American people and the nation, but rather what is best for their “alter America through judicial activism” agenda.

Liberal advocacy group MoveOn.org said Mr. McConnell’s early declaration that a vote would wait was a “shameful, partisan” move, and urged Mr. Obama to press the fight.

“Now it is time to follow the requirements of Article II of the Constitution, which gives the president the sole power to, with the advice and consent of the Senate, appoint a new Supreme Court justice,” said Anna Gallard, MoveOn’s executive director for civic action.

Democracy for America, another liberal advocacy group, launched a petition to demand Mr. Obama act quickly, and to pressure the Senate to confirm his pick.

Conservatives are adamant in their position that rushing is bad for America.

“This president, who has shown such contempt for the Constitution and the laws, is the last person who should be appointing his successor,” said Carrie Severino, chief counsel at the Judicial Crisis Network, a conservative legal pressure group. “The people’s voice should be heard in November to determine who will appoint the next Supreme Court justice.”

Whether the Senate GOP will actually stand strong in the face of this development and act in concert with  the will of their constituents who have given them their position, remains to be seen.

This however is a game changer for our country with so many important decisions before SCOTUS regarding Obama’s abuse of executive power.  The time is now to take back America and not acquiesce to the left’s hurried plan to fill the seat.
