Illegal Takes Former Employer to Court

Illegal alien Noe Escamilla slipped and fell in 2010 while on the job at Wabash College in Crawfordsville, Indiana. He was trying to lift a heavy piece of stone at the time, and now his doctors say he cannot lift more than 20 pounds. Escamilla is suing construction and maintenance company Shiel Sexton Co., and is claiming that his injuries prevent him from earning a living.

The 29-year-old Escamilla already tried to take his claims to court once, but a Montgomery County Superior Court judge ruled that, because he is an undocumented worker, he could not claim the money and benefits. The judge based her decision in part on the fact that Escamilla violated federal law by misrepresenting his immigration status on his job application.

He is now taking his case to the Indiana Court of Appeals to reverse Judge Heather Dennison’s ruling denying his claims.

KHOU.com reports that investigators discovered that, in 2008 when he was hired by Masonry by Mohler, a subcontractor of Shiel Sexton, he gave them a stolen Social Security number belonging to someone living in California.

The company never verified the worker’s information when he was hired. He was on the job two years before he was injured. Further, since his injury, Escamilla was granted permanent residency status by Obama’s Department of Homeland Security in 2014.

Some experts claim neither of the companies Escamilla is associated with have any liability at all and the plaintiff has no grounds at all to sue.

The case has no precedent in Indiana and could be a banner decision for illegal immigrants.

If the case is adjudicated in Escamilla’s favor, workers who have no legal status could benefit greatly in future injury cases and such a decision would tend toward breaking down the rules preventing illegals from receiving benefits for which they currently do not qualify.

Mr. Escamilla is in the United States illegally. He lied on his job application as to his identity. He stole a federal identification care and used it for illegal purposes. There are probably other ways that he has used the stolen document as well, and it would be interesting to determine if he is paying taxes on earnings from his job.

He took that job and thereby prevented a citizen from taking the position. This hardly appears to be someone “hiding in the shadows,” in fact it appears to be a blatant display of illegality. This does not seem to be the type of person that we want in our country. And yet, he may prevail in court. And Obama may even grant him amnesty if he stays long enough.

One can certainly sympathize with Mr. Escamilla, and there are no doubt circumstances that led him to travel to the U.S. to seek employment, but it is odd that Obama would prefer protecting illegal aliens over U.S. citizens and taxpayers. But that is the political machination that Obama is implementing, and it is clearly not benefiting those who live here.

To insure safety and self determination of citizens, a country must control its own borders and eject those who enter without proper vetting. In the case of Mr. Excamilla, though we can be sorry for his plight, his case should be rejected and he should be returned to his home country forthwith.
