The plaintiffs in the Alabama case argue and stipulate that the Second Article, First Section of the Constitution, uses the words ‘natural born’ – meaning ‘native born within the geographical borders of the United States of America or its territories and/or protectorate regions’.
The lawsuit (adequately) argues that Cruz was, indeed, born inside the borders of Alberta, Canada and that his father was holding a job there at the time when Cruz was born – on December 22nd, 1970. But according to Immigration law, Cruz is a U.S citizen because his mother was an American citizen – this being the main point of contention within the case itself.
Seeking clarification, the Attorney for the plaintiffs Atty. Thomas Drake II, also demanded in a letter drafted and sent to the Alabama Republican Party, that “an investigation and determination as to Cruz’ eligibility” must be made no later than February 20, 2016.

In an interview this last Friday (February 12th, 2016), Attorney for the plaintiffs Atty. Thomas Drake II, told Fox6 News (WBCR) that it is his contention that Cruz does not satisfy the requirements of the Constitution to be a ‘natural-born’ citizen of the Unites States of America.
Drake was also quoted as saying “At that time News (WBCR) of Mr. Cruz’s birth, at the moment of his birth, the location determined his status. And his status was that of a natural born citizen of Canada, not the United States.”

In addition to filing the suit, Drake demanded, in a letter drafted and sent to the Alabama Republican Party, that an investigation and a determination as to Cruz’s eligibility no later than February 20, 2016.
Now, nearly TWO WEEKS AFTER the lawsuit was filed, there has still been NO RESPONSE filed in federal court and a spokesperson for the Cruz campaign has declined to even so much as comment on the matter.
Cruz himself has responded to Trump’s question of citizenship during a debate, laying out the legal basis for why is is indeed qualified. He states that his mother was a United States citizen and then linked his birth to similar scenarios in previous GOP candidates, like John McCain and George Romney, who both ran for president, coming to the conclusion that the “legal issue is quite straightforward.”

Just saw a post on facebook exhibiting what is termed a Law Suit against Ted Cruz on the basis of his illegibility to seek the office of President. I made the same effort against Barack Obama in Pa. but was unsuccessful in my effort. The liberal Court would not even take up the issue. If it would help, and as I am still a legally registered, and Constitutionally eligible candidate for the office, I would be happy to join your suit on this matter. As Ted himself has cited Section 301 (g) of the INA as the basis for his citizenship, which, if properly filed, would make him a citizen, but it does not make him a “natural born” citizen. No act of law can do that, only the act of birth. My question to Mr. Cruz would be, “Why is it, a “natural born” American citizen needs to cite any section of the Immigration and Naturalization Act to verify their citizenship. The INA applies only to Immigrants and Naturalized citizens, it never applies to “natural born” citizens. Please feel free to contact me at any time.

Ted Cruz is not eligible to run for president of the united states and I can prove it. If I can prove it why can the so called legal scholars not prove it? A google search will bring up all of the legal immigration issues starting in the year 1952 as amended to the year Cruz was born. the actual legal quotes prove not only is he not eligible but in fact is an illegal alien. the legal quotes actually prove Obama , Rubio and both of Cruzes parents are illegal.
