The Third Amendment was created to protect your home from being quartered by soldiers without your consent. It has very rarely been a matter of debate or litigation, until now.
Federal district court Judge Andrew Gordon ruled that the police are exempt from the 3rd Amendment with a case out of Henderson, Nevada after a family had their home broken into and seized by local law enforcement who stated they needed the home to gain a “tactical advantage” against suspected criminals in a neighboring house.
Police actually forced their way into this family’s home, pepper-balled the father and his dog and then incarcerated the man for a day.

This story leaves a a lot of the facts. Troops were not placed in the home, the police were executing a perfectly valid search warrant.
As sual, here is a simple situation blown out of proportion by a goal-driven media. The house offered an optimum vantage point for the police to resolve a potential hostage situation with minimal – if any – loss of life. The on-scene commanders decided that there was no better option. The preservation of life took precedence over the home owner’s selfish desire for privacy – as it always should. This had nothing whatsoever to do with the 3rd amendment. Get your facts straight before spouting this ridiculous c**p, people!
It’s irrelevant. If the cops didn’t have a warrant no entry is allowed. PERIOD.
What media coverage are you talking about??? This stuff doesn’t get reported, and is the reason why most of the citizens in this country are oblivious to the dire situation we are in. The home owner was selfish??? He was assaulted and arrested in his own home because he didn’t want a team of police conducting their business in it? What planet are you from? Our homes are off limits to ANYONE we don’t want in them. Period.
The third amendment says nothing about “except when they decide it’s more important”
So your saying that it is perfectly OK for Police officers to force their way into a non criminals house assault the people living there and detain them for no reason what so ever because they are the Police.
Bull. I don’t CARE if the commanders saw it as a better option. Says NOTHING about this being a hostage situation and even if it WAS, WITHOUT PERMISSION you DON’T go busting in at the door of a private residence and PEPPERBALL the OWNER! Police work is dangerous and is RARELY done engaged in whilst there is a tactical advantage. You DEAL WITH IT! You don’t sit there and throw private property rights out the window. MOST domestic violence situations statistically do not end in hostage situations. Still half the time the PERPS are never even arrested or released the following day to set up a new scenario. You claim best chance at the preservation of life. And what of the life of this family in the midst of the CHAOS CAUSED BY THE POLICE if a child surprised SWAT MEMBERS or the owner had of pulled a weapon not knowing who it was that was attacking his home? He would be dead. What if the dog had attacked in the chaos and was shot and killed? You shoot and kill a police dog and the punishment is the same as if ot was a human. There is NO WINNER in the scenario in which cops comandeer a private home to gain “tactical advantage”. The police department should be shelling out money for damages to the home incurred by the “comandeering” (which seems more like a home invasion or hostile takeover), TRAUMA TO THE FAMILY(!), UNLAWFUL IMPRISONMENT of the man, pain and suffering for the man and dog for their pepperballing and another award for MENTAL TRAUMA/EMOTIONAL TRAUMA as well as the same for each additional member of the family that was present. Do you get that ot is likely that any youngsters that experienced that that night will likely see the cops and DEFINITELY SWAT as ENEMIES? FOR THE HELL that they went through at their hands doing nothing wrong or to deserve it? What about preservation of the PEACE and the preservation of the QUALITY of life?

Those cops should have been shot on sight they were committing a crime. they entered his home without a warrant.

Hopefully a very similar situation will occur in his home a bit after this ruling is not so fresh. He needs his door busted down at 3 in the morning and get a few wiffs of VX and a good pelting from rubber bullets as SWAT members bark orders at him, put his face (forcefully) into his hardwood kitchen floor, kick him a few times for resistance and then lock him up for a day. Just so he can have a different perspective and of course, no recourse.
