In a recent pre-trial hearing in Xenia, Ohio, a judge agreed with a prosecutor’s motion to prohibit the defendant from mentioning the Constitution or the constitutionality of the law he was charged with violating.
Judge Catherine Barber stated “there will be no mentioning of the Constitution” to the defendant, Virgil Vaduva.
The prosecutor made the claim that mentioning the Constitution “will confuse the jury,” to which Vaduva replied that uttering words on a public sidewalk, his panhandling charge, constitutes free speech.

Clearly a usurpation of authority…but,
If the man is contesting the cons$#%&!@*utionality of a statute, it is most likely a determination for the Ohio Supreme Court, or SCOTUS.
The judge appears to be limiting this man’s defense to the evidence he and the prosecution presents. If his defense is based on the cons$#%&!@*utionality of a statute, and not a matter of fact, the jury must be given ‘charge’ on the portion of the statute which the defendant believes has violated his cons$#%&!@*utional rights.
Also, this could just as easily be addressed through Habeas Corpus, but should have been addressed during his arraignment. The article doesn’t say…
Some things aren’t so cut and dry, but I don’t feel the judge is within her rights to place such a limitation on an American’s method of defense.
That is like asking you not to breathe, right. This is the real crisis in America, as the diversity train is running in every direction, with liberal freedom fighting to set the standard, over the norm.

Then she should be removed, disbarred, and kicked out of courthouse. If she & the jury doesn’t know the cons$#%&!@*ution well enough to make a fair verdict, none of them need to be there.
Overstepping her bounds and showing what a poor judge she is! Time to get rid of her now after making such a statement in court before the public!
Remove her. I love it that Americans are calling for the removal of the cancer that is Obama. Congress needs to be brought to task. This cancer is spreading.
