Federal Judge Overturns Hawaii Ordinance Banning GMOs

Ruling in direct defiance of a local Hawaii ordinance, a federal judge ruled that Maui is prohibited by federal law from banning foodstuffs containing GMOs. A Clinton appointee, Chief U.S. District Judge Susan Oki Mollway argued that the ordinance violated the Plant Protection Act, a federal law delegating the power to restrict certain types of plants solely to the Secretary of State.

On the face of it, this is a radical usurpation of the American people’s power. According to people like Judge Mollway, the express will of citizens can be overturned if some unelected official living thousands of miles doesn’t like agree with them. If it means that they and their children are exposed to untested genetically modified foods, so be it.
