The executive over-reach of Obama in his gun grab not only violates the 2nd Amendment rights of all Americans but also violates the 4th Amendment right to privacy, by seizing client/physician records that are held in the stewardship of the Social Security Administration and utilizing them to unlawfully remove the right to bear arms from otherwise law abiding citizens.
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
As the Obama Administration takes the privately protected records held by the Social Security Administration, which on their websites states, “we will protect privacy in all releases in accordance with all applicable laws” to use them to keep guns out of lawful citizen’s hands, it is effectively carrying out a political coup.
Current law prohibits individuals from buying a gun if, because of a mental health issue, they are either a danger to themselves or others or are unable to manage their own affairs. The Social Security Administration (SSA) has indicated that it will begin the rulemaking process to ensure that appropriate information in its records is reported to NICS. The reporting that SSA, in consultation with the Department of Justice, is expected to require will cover appropriate records of the approximately 75,000 people each year who have a documented mental health issue, receive disability benefits, and are unable to manage those benefits because of their mental impairment, or who have been found by a state or federal court to be legally incompetent. The rulemaking will also provide a mechanism for people to seek relief from the federal prohibition on possessing a firearm for reasons related to mental health.
America, don’t lie down in defeat on this. Your personal records, kept in faith and security at the Social Security Administration, are not for the taking of some low paid bureaucrat, who is carrying out Obama’s unConstitutional executive order. This Administration is bent on keeping you from your 2nd Amendment right to bear arms and is now stealing your personal records to do it. Be informed and stand your ground!
