Lawsuit Claims U.S. Can’t Deport Illegal Alien with Criminal Records if DREAMers


Despite Montes criminal records showing 4 convictions, including one for shoplifting just last year, there seems to be no logical reason for his being forced to return to Mexico. Because being an illegal alien and having a checkered criminal history is no reason to deport a young man with no claim to U.S. citizenship.

That much is certain. Or at least that is the narrative being spun by a creative group of lawyers in California filing a lawsuit in cohorts with various liberal advocacy hobby groups.

They state that Montes renewed his DACA protections in 2016 and was completely shocked by his deportation.

“They detained me, they took me to a center, they asked me a lot of questions, and I signed a lot of papers,” he said.

“Montes said he couldn’t understand anything he was signing and was not given any copies. Officers walked him to the U.S.-Mexico border and released him into Mexicali.

There, he found a friend who put him up for the night. He called another friend, who drove across the border to return his wallet and bring fresh clothes. Then things got worse.

Montes said he was jumped from behind, mugged and beaten. At that point, he decided he needed to get back home. He saw some people using a rope to climb over a section of the border wall and joined them. He was quickly captured by federal agents, questioned again and deported again.”

This is interesting as his lawyers also discuss his education and life in the U.S.

“…graduated high school in 2013. He started taking welding classes at a Southern California community college and paid for it by picking crops in California and Arizona.”

Does it make sense that Montes graduated high school and attended community college but could not understand the simple papers he signed at the deportation center?

Or does the official transcript of what happened as released by the DMS make sense?

“Burke, the DHS spokeswoman, said the department had no record of Montes being arrested and deported from California as he described. Instead, it only had a record of him being caught after climbing the wall on Feb. 19.”

People ought to draw their own conclusions. Everyone has a mind. It would serve people well to exercise that gift to form rationale opinions instead of emotional reactions.
